The House assembled at 11.00 am. of Friday, the 17th December, 2004 in the Assembly Hall with the Hon’ble Speaker in the Chair. 

MEMBERS  PRESENT:

            Hon’ble Chief Minister, 9 Cabinet Ministers, Chairman (Hill Areas Committee), 1 Minister of State and 44 Elected Members. 

QUESTIONS:                      

(a)       Hon’ble Chief Minister made a reply to Starred Question No. 609, asked by  Shri B.D. Behring, MLA regarding the recruitment of IRB/MR Personnel. 

(b)       Hon’ble Minister (Education) gave a reply to Starred Question No. 610, asked by  Shri Erabot Yumkham, MLA regarding the amalgamation of Schools. 

(c)       Hon’ble Minister (Education) made a reply to Starred Question No. 611, asked by Shri L. Ibomcha Singh, MLA regarding the appointment of regular Principals in  Government Colleges. 

(d)       Hon’ble Minister (Education) gave a reply to Starred Question No. 612, asked by  Shri P.S. Henry Paotei, MLA regarding the vacancies of Teaching Staff in the schools  of hill areas. 

(e)       Hon’ble Minister (CADA)  made a reply to Starred Question No. 613, asked by  Shri S. Gopal Singh, MLA regarding the steps taken by the Government under  CADA in Moirang A/C. 

(f)        Hon’ble Minister (Food & Civil Supplies) gave a reply to Starred Question No. 614, asked by Shri Ningthoujam Biren, MLA regarding the S.K. Oil quotas of Sekmai A/C. 

(g)       Hon’ble Minister (Education) made a reply to Starred Question No. 615, asked by  Shri M. Nilchandra Singh, MLA regarding the fund availability under PMGRY. 

(h)       Hon’ble Minister (Education) gave a reply to Starred Question No. 616, asked  jointly by S/Shri I. Hemochandra Singh and Ningthoujam Biren, MLAs regarding  the appointment of cooks of mid-day-meal. Hon’ble Chief Minister further  supplemented to the answer.  

(i)        Hon’ble Minister (Forest) made a reply to Starred Question No. 617, asked by  Shri Samuel Jendai, MLA regarding the eviction of tribal villages in Langol Hills. 

(j)        Hon’ble Chief Minister gave a reply to Starred Question No. 618, asked by  Shri S, Chandra Singh, MLA regarding the measures taken up by the government to  check kidnapping. 

            Answers to Starred Question Nos. 619 & 620 were laid on the Table of the House as written answer. 

ZERO  HOUR: 

            During Zero Hour, Shri B.D. Behring, MLA drew the attention of the Chief Minister for payment of salaries and pensions before Christmas. Shri L. Ibomcha Singh, MLA also raised a matter regarding misappropriation of mid-day-meal rice meant for Tamenglong District. 

OBITUARY  REFERENCE: 

            Hon’ble Speaker Shri T.N. Haokip moved a resolution on obituary reference on the demise of Shri Telem Bira Singh and Shri T.P. Kuilengpao, former Members of the  Manipur Legislative Assembly and Shri Ningombam Raghumani Singh, former Secretary of Manipur Legislative Assembly.           

            Hon’ble Member Shri R.K. Dorendra Singh, Hon’ble Agriculture Minister, Shri P. Parijat Singh, Hon’ble Power Minister, Shri Gaikhangam, Hon’ble MemberShri E. Biramani Singh and  Hon’ble Chief Minister, Shri O. Ibobi Singh participated in the obituary reference.         

            The House observed two minutes silence in respect of the departed souls. 

            The following resolution was adopted by the House:-           

“That, this House expresses its deep and profound sorrow at the sad  demise of Shri Telem Bira Singh and Shri T.P. Kuilengpao, former Members of the  Manipur Legislative Assembly and Shri Ningombam Raghumani Singh,  former Secretary of Manipur Legislative Assembly.  

And, that the Members of this House observed two minutes silence by  standing to pray to the Almighty God for the eternal peace of the departed souls.” 

PAPERS  LAID  ON  THE  TABLE: 

(a)       Shri O. Ibobi Singh, Hon’ble Chief Minister laid a copy of the Annual Report, 2003-2004 of the State Vigilance Commission, Manipur. 

(b)       Shri P. Parijat Singh, Minister (Art & Culture) laid a copy of the Kangla Fort Ordinance, 2004 (Manipur Ordinance No.1 of 2004). 

INTIMATION  OF  GOVERNOR’S  ASSENT  TO  BILL: 

            The Secretary, Manipur Legislative Assembly intimated the House the Governor’s Assent to The Manipur Appropriation (No.3) Bill, 2004. 

PRESENTATION  OF  COMMITTEE  REPORT: 

(a)               Shri O. Ibobi Singh, Chief Minister presented the Eleventh Report of the Business Advisory Committee, 2004 and also moved: 

“that the House agrees with the allocation of time proposed by the Committee.” 

The House agreed. 

(b)              Shri M. Nilchandra Singh, Member of the General Purposes Committee presented the First Report of the Committee and moved for adoption. 

            The House adopted the Report of the Committee. 

(c)              Dr. M. Nara Singh, Chairman of the Committee on Welfare of Women and Children presented the First Report of the Committee and moved for adoption. He made a brief statement. 

            The House adopted the Report of the Committee. 

CALLING   ATTENTION: 

            Shri O. Joy Singh, MLA called the attention of the Revenue Minister on the recent eviction drive in the Manipur University Campus. While welcoming the eviction drive being in the larger interest of the state, Shri O. Joy Singh said that it grossly violated the due process and procedure of law and broad outlook of modern democracy. He said that provisions of MLR & LR  Act, CrPC and IPC were violated in the eviction process. He also observed that land compensation rate was very low in this respect. He further said that he was arrested and confined without proper procedure of law affecting his personal liberty and political prestige. 

            Shri Th. Devendra Singh, Hon’ble Minister (Revenue),replying to the motion said that there might be some procedural lapses in the execution of the eviction process because of the rising exigencies and also of maintaining tranquility and peace. He, however, assured that he would look into the matter. 

            On being pressed by Shri O. Joy Singh to take up appropriate action on the matters by the government, the Revenue Minister said that he would make a further statement within the current session. 

MOTION  FOR  ELECTION  OF  MEMBERS  TO  FINANCIAL  COMMITTEES: 

(a)               Shri S. Ibohal Singh, Chairman of the Committee on Public Accounts moved the following motion: 

“that in pursuance of Rule 233(1) of the Rules of Procedure and Conduct     of Business in Manipur Legislative Assembly, the members of the Manipur  Legislative Assembly do proceed on December 23, 2004 to elect 7 (Seven)  members from amongst themselves to serve as members of the Committee  on Public Accounts.” 

(b)              Shri B.D. Behring, Chairman of the Committee on Estimates moved the following motion: 

“that in pursuance of Rule 233(1) of the Rules of Procedure and Conduct     of Business in Manipur Legislative Assembly, the members of the Manipur Legislative Assembly do proceed on December 23, 2004 to elect 7 (Seven) members  from amongst themselves to serve as members of the Committee on Estimates.”           

(c)              Shri S. Chandra Singh on behalf of the Chairman of the Committee  on Public Undertakings moved the following motion: 

“that in pursuance of Rule 233(1) of the Rules of Procedure and Conduct     of Business in Manipur Legislative Assembly, the members of the Manipur Legislative Assembly do proceed on December 23, 2004 to elect 7 (Seven)    members from amongst themselves to serve as members of the Committee  on Public Undertakings.” 

The House agreed and the motions were adopted.

PRESENTATION  OF  SUPPLEMENTARY  DEMANDS  FOR  GRANTS: 

            Shri O. Ibobi Singh, Chief Minister presented the Supplementary Demands for Grants, 2004-2005. He made a brief statement. 

INTRODUCTION  OF  BILLS: 

(i)                Shri O. Ibobi Singh, Chief Minister moved for leave to introduce the Manipur Ceiling on Government Guarantee Bills, 2004. 

            The House granted leave and the Bill was introduced. 

(ii)             Shri P. Parijat Singh, Hon’ble Minister (Art & Culture) moved for leave to introduce the Kangla Fort Bill, 2004. He made a brief statement. 

            The House granted leave and the Bill was introduced.           

(iii)           Shri O. Ibobi Singh, Chief Minister moved for leave to introduce the Manipur Municipality (Second Amendment) Bill, 2004.  

The House granted leave and the Bill was introduced. 

            (iv)      Shri O. Ibobi Singh, Chief Minister moved for leave to introduce the Manipur
                        Value Added Tax Bill, 2004.  

The House granted leave and the Bill was introduced. 

            The Hon’ble Speaker informed the House that cut motions on the Supplementary Demands for Grants, 2004-2005 could be submitted upto 3.00 pm of 18th December, 2004. 

The Hon’ble Speaker, Shri T.N. Haokip, adjourned the House  at 2.08 pm  till 11.00 am of Monday, the 20th December, 2004.
